Terms of Service — AdStream

By creating an account or using AdStream, you agree to these terms. Please read them carefully. If you disagree with any part, you may not use AdStream.

1. Who We Are

AdStream is an AI-powered advertising automation platform operated by Polsia ("we," "us," "our"). These Terms govern your use of the AdStream service available at adstream-d7ek.polsia.app and any associated APIs or features.

2. Eligibility

You must be at least 18 years old and capable of entering a binding contract to use AdStream. By using AdStream, you represent that you meet these requirements. AdStream is intended for business use — by signing up, you represent that you are acting on behalf of a legitimate business or as an individual entrepreneur.

3. Your Account

You are responsible for:

Keeping your login credentials secure
All activity that occurs under your account
Promptly notifying us of any unauthorized access

You may not share your account with others or create accounts on behalf of someone else without their consent.

4. The Service

What AdStream Does

AdStream uses AI to generate advertising copy and, with your authorization, publishes that content to your connected Facebook Pages and Instagram Business accounts via Meta's official Graph API.

AI-Generated Content

The ad copy AdStream generates is produced by AI. You are responsible for reviewing content before publishing. We do not guarantee that AI-generated content is accurate, appropriate, legally compliant, or effective for your business. You must review and approve all content before it goes live.

Social Platform Integration

When you connect your Facebook or Instagram account, you authorize AdStream to publish content on your behalf using Meta's official APIs. You remain fully responsible for all content published to your accounts, whether generated by AI or manually edited. You must ensure your use of AdStream complies with Meta's Terms of Service, Meta's Advertising Policies, and all applicable laws.

5. Acceptable Use

You agree not to use AdStream to:

Publish false, misleading, defamatory, or fraudulent content
Violate Meta's Terms of Service, Community Standards, or Advertising Policies
Publish content that infringes on intellectual property rights of third parties
Distribute spam, malware, or any harmful content
Engage in illegal discrimination (targeting by race, religion, national origin, etc.) in advertising
Promote illegal products or services
Attempt to circumvent any security or rate limiting features of AdStream or Meta's APIs
Use AdStream to harass, threaten, or harm any individual or group

We reserve the right to suspend or terminate accounts that violate these terms at our sole discretion.

6. Subscription and Payments

Billing

AdStream operates on a subscription model. By providing payment information, you authorize us to charge your payment method on a recurring basis for your selected plan. All prices are in USD unless otherwise stated.

Free Tier

A free tier is available with limited monthly ad generations. Free tier users do not have access to auto-posting features.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not issue refunds for partial billing periods.

Price Changes

We reserve the right to change pricing. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

7. Intellectual Property

Your Content

You own the ad content published through AdStream. You grant us a limited license to store and transmit your content for the purpose of providing the service.

Our Platform

AdStream, including its software, design, and the AI systems underlying it, are owned by Polsia. You receive a limited, non-exclusive, non-transferable license to use AdStream for your own business purposes. You may not copy, modify, reverse engineer, or distribute any part of the platform.

AI-Generated Output

AI-generated ad copy produced through AdStream is provided to you for your use. We make no warranties about the originality of AI-generated output and you are responsible for ensuring published content does not infringe third-party rights.

8. Disclaimers

AdStream is provided "as is" without warranties of any kind, express or implied. We specifically disclaim:

Any warranty that the service will be uninterrupted, error-free, or free of harmful components
Any warranty about the accuracy, completeness, or quality of AI-generated content
Any warranty that published ads will achieve any particular business result
Any warranty regarding Meta's platform availability or API reliability

9. Limitation of Liability

To the maximum extent permitted by law, Polsia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of AdStream — including lost profits, lost data, reputational damage, or any claims by third parties regarding published content.

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Polsia, its officers, employees, and agents from any claims, damages, or costs (including reasonable attorneys' fees) arising from: (a) your use of AdStream, (b) content you publish through AdStream, (c) your violation of these Terms, or (d) your violation of any third-party rights.

11. Third-Party Services

AdStream integrates with Meta's platforms (Facebook and Instagram), Stripe for payments, and OpenAI for AI content generation. Your use of those services is governed by their respective terms of service. We are not responsible for the availability, reliability, or policies of these third-party services.

12. Privacy

Your use of AdStream is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Termination

We may suspend or terminate your access to AdStream at any time if you violate these Terms, engage in fraudulent activity, or if we determine your use poses a legal or reputational risk. Upon termination, your right to use AdStream ends immediately. We will provide notice where practicable.

You may terminate your account at any time by contacting support@adstream.polsia.app.

14. Changes to Terms

We may update these Terms over time. We'll notify you by email or via in-app notice at least 14 days before material changes take effect. Continued use of AdStream after changes take effect constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under AAA Commercial Arbitration Rules, with proceedings conducted in English.
